The Building Department is located on the Second floor of the Alexander Community Center at 275 Alexander Avenue.  Office hours are 9:00 a.m. to 4:00 p.m. Monday through Friday.  The various inspectors can be contacted directly and have voice-mail for messages. The Town of Cheektowaga Building Inspection Department is the first stop for all proposed developments or construction within the Town.  In addition to reviewing plans, issuing building permits and conducting inspections, the office provides the following services or functions:

Permits are required for new structures, additions, renovations, swimming pools, sheds, demolition of buildings, etc.  Permits are also required for plumbing work. It is advisable to contact the office when any work or improvements are contemplated for any residential or commercial/industrial property.  Local/state regulations may require certain approvals or reviews.

Permit Requirements for a Change in Commercial Occupant -  Prior to occupying any commercial space within any building in the Town of Cheektowaga a change in commercial occupant permit must be applied for and approved by the Building Department.  If you are proposing a new store or business within the Town of Cheektowaga, whether it involves a purchase or lease of a store front, commercial space, or portion of an existing building, plans must be presented to the Building Department for the utilization of such commercial space/building.  Plans are required even if there are no proposed alterations or renovations. A permit and plan requirement is necessary so that the Building Department can confirm that the proposed business is permitted under the Zoning Law and that the intended use of the space/building complies with the "Existing Building Code of New York State".  


The Town of Cheektowaga is mandated by New York State to administer and enforce the New York State Uniform Fire Prevention and Building Code. The current series of codes adopted by New York State include:
Residential Code of NYS 2010
Building Code of NYS 2010
Existing Building Code of NYS 2010
Plumbing Code, Mechanical Code and Fuel Gas Code of NYS 2010
Energy Conservation Construction Code of NYS 2010
Fire Code and Property Maintenance Code of NYS 2010

On October 3, 2016 the above codes will be replaced by the 2015 series of International Codes and the "2016 NYS Supplement" to such codes. The new codes may be utilized now if desired by the applicant providing the applicant identifies on his/her application submittal that they are utilizing such codes.

Pre-filing Project Review
- The Town Planner will meet with developers/applicants to discuss proposed projects.  Information concerning all aspects of planning a site will be provided.   These include zoning setbacks, parking requirements, landscaping, other agency involvement and potential area of concern based on past projects and discussions with agencies.

Environmental Review Coordination
-The Town Planner receives and coordinates review of projects subject to NYS SEQRA (State Environmental Quality Review Act) regulations.  Provides guidance in filing of applications, acts as intake officer and provides general oversight of the environmental review process.

The Town of Cheektowaga is committed to fighting vacant, abandoned and “zombie properties” in our neighborhoods.  We need your help in identifying such properties.  The general public can assist in this endeavor by calling the Town’s Vacant and Abandoned Property hotline at 716-897-7200 ext. 1 and report any known or suspected vacant property.  The Town will also report vacant properties to the New York State Department of Financial Services Zombie Property Registry

The New York State Department FS is compiling a list of all “zombie properties” and will work to make sure the banks/mortgagors maintain the properties.  The Town of Cheektowaga will have access to the NYSDFS list and will work with the service companies to keep the property maintained.
